U.S. State Privacy Laws

Many states (30) have enacted Privacy Laws specifically targeted at protecting sensitive data.  It started with California's state bill 1386 (CA SB 1386) which simply stated if a company had a security breach that may have exposed California's resident sensitive information, that company must alert each person that said breach occurred.  This bill led to a series of public notifications of security breaches, causing significant brand damage as well as direct costs.  Since California's bill, many other states have adopted similar measures.

The key to these bills is that most allow for a safe-harbor in that if the data breached is encrypted, then no notification is needed.
